1. Reporting Births of Children
of Filipino Citizens |
|
|
The Report of
Birth is a declaration of the person furnishing information
on the birth abroad of a Filipino child. It is important for
Filipinos permanently residing abroad to promptly register
with the Embassy the birth of a child in order for such a
birth to be registered with the Office of the Civil
Registrar General in Manila. |
|
|
|
|
|
When a child is
born abroad to parents who are both Filipino citizens or to
one (1) parent who is a Filipino citizen, i.e. one who has
not been naturalized as a citizen of a foreign country, the
child's birth must be immediately reported to the Philippine
Embassy which exercises jurisdiction over the place of
birth. |
|
|
|
|
|
Ideally, the
birth must be reported to the Embassy within twelve (12)
months after its occurrence. When the parents neglect to
report the birth within twelve (12), the birth may,
nevertheless be recorded upon the determination of the
consular officer of satisfactory evidence on the
authenticity of the report. In these cases, the person who
executed the report shall furnish the Embassy with an
explanation surrounding the delay in reporting the birth. |

Procedures and
Requirements |
|
|
1. Four (4)
original duly accomplished Report
of Birth Form
should be executed by at least one of the parents or the
attending physician or nurse. When the birth is reported in
person, the Report of Birth will be sworn to before a
consular officer. If the Report is sent through mail, the
Report of Birth Form must be notarized. |
|
|
|
|
|
2. Original copy and
four (4) photocopies of
the child's Certificate of Birth issued by local health
authorities or by the local County Registrar and attested by
Ministry of Foreign Affairs (MOFA) must be
presented. |
|
|
|
|
|
3. Original copy
and four (4) photocopies of the data page of the Philippine passport(s) of Filipino parent(s). |
|
|
|
|
|
4. Original
copy and four (4) photocopies of the marriage certificate of
parents. |
|
|
|
|
|
5.
The fee for this service is $25.00 / Rs. 7,500.00 in cash.
Personal checks, personal money orders, ATM and credit
cards are not accepted as mode of payments. |
|
|
|
|
|
The Embassy
assumes no responsibility for any loss or damage through the
mail. |
|

|

6. Additional Requirements: |
|
|
1. If the birth was reported late (more
than 12 months after its occurrence), the person executing
the report must provide an Affidavit
of Delayed Registration explaining
the circumstances surrounding the delay with additional
fee of $25.00 / Rs. 7,500.00. Here is the form of
Delayed Registration of Birth. |
|
|
2. If parents are not married and child is to bear the
father's name, the father must execute and Affidavit of
Acknowledgement of Paternity (to be executed by Father) and
Affidavit to Use of Father's Surname (to be executed by
Mother). |
|
|
3. If parents were not married at the time of birth of
the child and eventually married thereafter, a Joint
Affidavit of Legitimation must be included in the
application. |

2. Recognition
as a Filipino Citizen |
|
|
Under the Bureau
of Immigration's Law Instruction No. RBR-99002, issued on 15
April 1999, any child born of a Filipino parent may be
recognized as a Filipino citizen under existing laws. The
following documents are to be submitted to the Commissioner
of Immigration: |
|
|
|
|
|
1. Petition, in
the form of a letter-request, made under oath by the
Filipino parent or legally appointed guardian. A person who
is 18 years old must apply in his/her own capacity. |
|
|
|
|
|
In default
of parents or a judicially appointed guardian, the following
persons shall exercise substitute parental authority over
the child in the order indicated: |
|
|
|
|
|
|
a. The
surviving grandparent as provided in Article 214 of the
Family Code; |
|
|
|
|
|
|
|
|
|
b. The oldest
brother or sister over 21 years of age, unless unfit or
disqualified; and |
|
|
|
|
|
|
|
|
|
c. the child's
actual custodian, over 21 years of age, unless unfit or
disqualified; |
|
|
|
|
|
|
In case the
letter-request is made by a person on behalf of any of the
parents, the legally appointed guardian, or persons
exercising substitute parental authority, he or she must be
duly authorized through a power of attorney to file such
petition. |
|
|
|
|
|
2.
Authenticated birth certificate of the child; |
|
|
|
|
|
3. Birth
certificate of the Filipino parent; |
|
|
|
|
|
4. Affidavit of
Citizenship executed by the applicant's Filipino parent
attesting to his/her citizenship at the time of the birth of
the child; |
|
|
|
|
|
5. Photocopy of
the child's passport, if he/she has one; |
|
|
|
|
|
6. Photocopy of
the Filipino parent's passport, if he/she has one; |
|
|
|
|
|
7. Proof of
Filipino citizenship of a parent at the time of birth of the
child other than the parent's passport or the child's
passport. |
|
|
|
Note: All
documents issued by the foreign governments and those
executed in a foreign country shall be duly authenticated by
the authorized officer of the Philippine Embassy that has
jurisdiction over them. |
|
|
|
|
|
|
|
|
|
Communications,
statements, or documents executed in a language other than
English or Filipino should be officially translated under
the seal of the authorized officer of the appropriate
foreign embassy. |
|
|
|
|
|
|
|
|
|
Pursuant to
Executive Order No. 292, the Bureau of Immigration, through
its Records Section, will automatically furnish the
Department of Justice an official copy of its Order of
Recognition within 12 days from its date of approval.
Identification Certificates shall be issued only after
confirmation by the Secretary of Justice. |

3. Reporting a
Marriage Contracted Outside the Philippines |
|
|
ONLY marriages
contracted in the following places can be registered or
reported at the Philippine Embassy, Islamabad, Pakistan: (1)
Afghanistan; (2) Kyrgyzstan; (3) Tajikistan |
|
|
|
|
|
For marriages
outside of its jurisdiction, the Report of Marriage must be
filed with the Philippine Embassy or Consulate which
exercises jurisdiction over the place of marriage. |
|
|
|
|
|

|
Procedure and Requirements: |
|
|
1.
Four (4) original duly accomplished Report
of Marriage Contracted Abroad form,
typed or printed legibly in black or blue ink, signed by
both husband and wife. Wives should indicate their maiden
name as the last name. If submitting by mail, the complete
forms must be notarized. |
|
|
|
|
|
2. Covering
letter (handwritten or typed), address to the Consular
Section, indicating service/transaction requested and
telephone number or email address for contact details. |
|
|
|
|
|
3. One (1) original or certified true copy and four (4) photocopies of
the Marriage Certificate or Contract (original will be
returned) and attested by Ministry of Foreign Affairs (MOFA)
must be presented. |
|
|
|
|
|
4. One (1)
original or certified true copy and four (4) photocopies of
the Birth Certificate of the husband and the wife. The
Consular Officer reserves the right to require additional
proof or documents from an applicant, to prove his/her
citizenship or identify pursuant to the Philippine Passport
Law (R.A. 8239) and the Foreign Service Act (R.A. 7157). |

5.
Four (4)
photocopies of a government-issued identification card or
passport of both husband and wife. |
|
|
|
|
|
6.
Processing fee of $25.00 / Rs. 7,500.00 (non-refundable),
payable in cash, when personally applying or postal money
order. Personal check and credit cards are not accepted. |
|
|
|
|
|
Additional
Requirements: |
|
|
1.
If the Report of Marriage is filed after 12 months of the
date of marriage, an Affidavit
of Delayed Registration of Marriage must
be accomplished, explaining
the circumstances surrounding the delay with additional

2. For
contracting parties of the marriage who were previously
married, the following additional documentary requirements
must be submitted: |
|
|
|
a. If Filipino
applicant had a previous Philippine marriage annulled, an
original and four (4) photocopies of the PSA-issued
Annotated Marriage Certificate (which indicates the details
of the annulment) and/or DFA-authenticated Judicial Decree
of Annulment with Certificate of Finality. |
|
|
|
|
b. If Filipino
applicant is divorced and divorce was initiated by foreign
spouse, one (1) original or certified true copy and four (4)
photocopies of DFA-authenticated Judicial Recognition of
Foreign Divorce issued by a competent Philippine Court with
Certificate of Finality. |
|
|
|
|
|
|
|
|
|
Divorce is not
recognized in the Philippines but when a divorce is validly
obtained abroad by an alien spouse from his or her Filipino
spouse, the Filipino spouse shall have the capacity to
remarry under Philippine law. Divorce, however, must be
recognized in the Philippines courts. The foreign divorce
decree must be judicially enforced or confirmed in the
Philippines by filing the proper civil action at the
Regional Trial Court in the Philippines (RTC-Phil). |

The Philippine Embassy will convey the Report of Marriage
and annexed documents to the Philippine Statistics Authority
(PSA) of the Philippines. It takes about six (6) months for
the ensuing Philippine Certificate of Marriage to be
available for ordering from the PSA in the Philippines. |

4. REPORT OF
DEATH OF FILIPINO CITIZENS |
|
|
Procedures and
Requirements: |
|
|
1.
Four (4) original duly accomplished Report
of Death form should
be executed by next of kin or the attending physician or
nurse or their duly designated representative. When the
death is reported in person, the Report of Death will be
sworn to before a consular officer. If the Report is sent
through mail, the Report of Death form must be notarized. |
|
|
|
|
|
2. The original
copy of the Certificate of Death issued by the local health
authorities or by the local County Registrar must be
presented. The Certificate of Death should also be
reproduced in quadruplicate (four copies). |
|
|
|
|
|
3. A copy of
the Philippine passport of the deceased must be submitted,
also reproduced in quadruplicate (four copies), in order to
determine Filipino citizenship. In the absence of the
passport, any other form of identification showing Filipino
citizenship (Birth Certificate/Identification, etc.) |
|
|
|
|
|
4. The fee for
this service is $25.00 / Rs. 7,500.00 in cash. Personal
checks, personal money orders, ATM and credit cards are not
accepted as mode of payments. Do not send payment in cash
when reporting my mail. |

for Shipment of Remains to the Philippines |
|
|

Requirements: |

|
Note: All documents to be submitted must be one (1)
original and four (4) photocopies. |

the Duly accomplished Report
of Death for
Filipino citizens; |
|
|
|
|
|
2. Original
copy and four (4) photocopies of Certificate of Death; |
|
|

copy and four (4) photocopies of the Burial Transit Permit; |

4. Original
copy and four (4) photocopies of the Health Certificate
issued by the Department of Health stating that death was
not due to a contagious disease and/or that the human
remains do not pose any danger to public health. Original
copy of the Health Certificate must be notarized.; |

copy and four (4) photocopies of the Mortuary Certification
that the casket contains only the human remains of the
deceased or Crematory Certificate that the urn contains only
the ashes of the deceased (notarized). The Certificate must
state that the remains was embalmed/cremated in accordance
with state or local laws; |

transportation arrangements: |
